Warranty Policy
Limited Warranty is non-transferable. The following Limited Warranties are given to the original retail purchaser of SHAPE FLEXER SUNHATS.
MANUFACTURING DEFECTS
90 Day Limited Warranty
The Shape Flexer is made from synthetic materials assembled exclusively via stitching. Materials used in the manufacture of sunhats are expected to wear and show regular signs of wear as they are used in an ordinary manner. Shape Flexer warrants the quality of our sunhats to you, the original retail purchaser, for 90 days from the date of receiving the order, against manufacturing defects. An example of an issue that would be considered a manufacturing defect is the stitching being loose where the crown meets the brim with NO signs of above average wear and tear. Examples of issues that would not be covered under this warranty would be issues related to damage, abuse or any use of the product that does not fit a standard usage of a sunhat as deemed by Shape Flexer. If an item is deemed to be covered by our limited warranty, Shape Flexer will provide, within 90 days from the date of receipt, a replacement sunhat at no charge to the original purchaser.
NOTE:
Any item replaced under this limited warranty will be covered by the limited warranty for the remainder of the original warranty period only.
LIMITATIONS AND EXCEPTIONS
Registration
In order to qualify for the limited warranty, Shape Flexer requires the product purchase be registered via the warranty product registration page available at shapeflexer.com within 2 weeks of the original purchase date. While Shape Flexer will make every reasonable attempt to ensure that this limitation is made known to its customers, the original purchaser bears the responsibility of registering the product and understanding the terms, requirements and restrictions of the limited warranty. Remedy
Under our Limited Warranty, the sole liability of Shape Flexer is limited to replacement. Shape Flexer will pay, within 90 days from the date of purchase, for replacement and shipping costs at no charge to the original purchaser. After 90 days from the date of receipt, the original retail purchaser will no longer have a manufacturer’s defect warranty on the product.
Extended Warranty is non-transferable. The following Limited Warranties are given to the original retail purchaser of SHAPE FLEXER SUNHATS.
10 Year Brim Cable Extended Warranty
Shape Flexer warranties the brim cable from breaking for 10 years after the date of the product receipt by the original purchaser. In order to qualify for brim cable extended warranty, Shape Flexer requires that the product purchase be registered via the warranty product registration page available at shapeflexer.com within two weeks of the original purchase date. While Shape Flexer will make every reasonable attempt to ensure that this limitation is made known to its customers, the original purchaser bears the responsibility of registering the product and understanding the terms, requirements and restrictions of the limited warranty. NOTE:
The item replaced under the brim cable extended warranty will be covered by the extended warranty for the remainder of the original warranty period only.
NOTE:
Any evidence of attempt to remove the brim cable by force (e.g. cutting it out of the hat) will void the 10 year brim cable warranty.
All Products
Our Limited Warranty provides coverage to the original retail purchaser and only applies to standard sunhat uses. Our Limited Warranty does not apply to (i) merchandise that was, at any time, used as a floor sample or display model, (ii) any merchandise purchased “as is” or second-hand, (iii) any merchandise purchased at a distress sale or a going-out-of business sale, or (iv) any merchandise purchased from a liquidator. All warranties, whether expressed or implied, cover only normal wear and tear or common sunhat usage. No warranty, expressed or implied, applies to any condition resulting from misuse, abuse, delivery or transportation damage, nor any condition resulting from incorrect or inadequate maintenance, cleaning or care. Warranty is null and void if product has been damaged in the process of any attempted repair by the original purchaser.
Chemical Treatments
Our Limited Warranty does not cover damages or defects caused by use of chemical treatments or protective coatings on the fabric by the retailer or the original retail purchaser, and any such chemical treatments or protective coatings voids all warranties of Shape Flexer.
Fabrics and Materials
The Limited Warranty on all materials including but not limited to “Fabric” and “Zipper” does not cover (i) damages resulting from excessive soiling, improper or unapproved cleaning methods, (ii) damages resulting from excessive household/storage humidity (e.g. mildew), or (iii) damages resulting from any liquid, including but not limited to alcohol and water. CAUTION: Any use of improper or unapproved cleaning methods voids all warranties of Shape Flexer.
Modifications to Products
The Limited Warranty does not apply to any products that have been altered by any person, dealer, or company without the express written authorization of Shape Flexer.
Implied Warranties
IMPLIED WARRANTIES, INCLUDING ANY OF MERCHANT-ABILITY AND FITNESS FOR A PARTICULAR PURPOSE IMPOSED ON THE SALE OF THESE PRODUCTS AND ITS PARTS UNDER STATE LAW, ARE LIMITED TO 90 DAYS.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
DISCLAIMER
NO OTHER EXPRESS WARRANTY HAS BEEN MADE OR WILL BE MADE ON BEHALF OF SHAPEFLEXER WITH RESPECT TO THE SUNHAT AND ITS PARTS, OR THE OPERATION, REPAIR, OR REPLACEMENT OF THE SUNHAT AND ITS PARTS. FURTHERMORE, NO REPRESENTATIVE OF SHAPEFLEXER OR ITS DISTRIBUTORS OR RETAILERS IS AUTHORIZED TO MAKE ANY CHANGES OR MODIFICATIONS TO THIS LIMITED WARRANTY.
SOME RETAILERS OFFER EXTENDED OR ADDITIONAL WARRANTIES, INCLUDING BUT NOT LIMITED TO EXTENDED OR ADDITIONAL FABRIC WARRANTIES, EITHER FROM THE RETAILER OR THROUGH A THIRD-PARTY. SHAPEFLEXER SHALL NOT BE LIABLE UNDER ANY EXTENDED OR ADDITIONAL WARRANTIES OFFERED BY ANY RETAILER OR THROUGH A THIRD-PARTY.
IN NO EVENT SHALL SHAPEFLEXER BE RESPONSIBLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SUCH AS LOSS OF USE, INCONVENIENCE, LOSS OR DAMAGE TO PERSONAL PROPERTY, WHETHER INDIRECT OR DIRECT, AND WHETHER ARISING IN CONTRACT OR TORT. IN NO EVENT SHALL SHAPE FLEXER’S RESPONSIBILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT OR ITS REPLACEMENT.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
REMEDY AND CLAIM PROCEDURE
Remedy
If within the warranty period, identical materials are unavailable at the time of replacement, Shape Flexer reserves the right to substitute products of equal or better quality or just provide a full original purchase price refund. Replacement products may vary slightly in color or overall style from the original.
Any item replaced under this limited warranty will be covered by the limited warranty for the remainder of the original warranty period only.
Claim Procedure
If a problem should arise which you feel is covered by our Limited Warranty, contact Shape Flexer directly via email at "info@shapeflexer.com". The original bill of sale or order number are necessary for the fulfillment of the warranty. In some cases, pictures or the actual product may be required in person to validate eligibility. Please make sure any claim for warranty service is accompanied by the necessary information to satisfy the warranty requirements. Not doing so will slow down the process. Shape Flexer reserves the right to require defective products be returned upon request.
